About these terms
These terms are a legal agreement between you and Hussain Syed, who runs Cookmee as an individual ("we", "us"). They cover your use of Cookmee (the "app"), our website and the pages for shared recipes, and all the recipes, text, photos and other content in them (together, the "service"). The Community rules are part of these terms. The Privacy Policy explains how we handle information.
Please read these terms carefully, especially the parts about allergies, food safety and health, our responsibility, your responsibility, and settling disputes. The section on settling disputes asks you to resolve most disputes in individual arbitration and not in a class action, and tells you how to opt out.
Accepting these terms
You accept these terms when you tap "Agree and continue" on the first screen, or when you sign in and confirm the line about the Terms. We keep a record of the version you accepted and when.
You also accept these terms, the Community rules and the Privacy Policy by downloading, opening or using the app or the website, with or without an account, as far as the law allows. This adds to the tap above. It does not replace it. If you do not agree, do not use the service. If you continue without agreeing, some features stay closed, and these terms still apply to what you do use.
Who can use the app
The service is for people in the United States aged 13 and over. You need to be 13 or over to make an account. You need to be 18 or over to share recipes with Everyone or to take part in public groups. If you are under 18, you may use the service only with a parent or guardian's permission, and they agree to these terms for you and are responsible for your use.
Do not use the service if we have closed your account before, if the law bars you from using it, or if you are in a country under a US embargo or on a US list of restricted parties.
Your account
You do not need an account to cook, plan, spin or read. You need one to share and to take part in the community. You sign in with a third-party account such as Google, under that company's terms.
- Give true information and keep your sign-in account secure. You are responsible for everything done through your account.
- One person, one account. Do not share, sell or transfer your account, or make accounts to get around a limit or a ban.
- Tell us straight away if you think someone else is using your account.
- You can delete your account at any time in the app. The Privacy Policy says what is deleted and what is kept.
Using the app
We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own cooking at home, under these terms and the app store's rules. Do not:
- copy, sell, rent, license or misuse the service or its content, or use it in a food business, a paid service or for advertising
- scrape, crawl, index, download in bulk or use bots or other automated tools to collect content or data, or reach our servers by any means other than the app and the website
- use any content from the service to train, tune or test artificial intelligence or machine-learning models
- reverse engineer, decompile or change the app, remove notices from it, or get around its limits, checks, age rules or security
- send or share anything that breaks the Community rules, is unlawful, or that you have no right to share
- harass, threaten, impersonate or deceive anyone, or collect other people's information
- interfere with the service, test its weaknesses, overload it or spread malware
- help or encourage anyone else to do these things
We may investigate misuse and take the action set out under "Our rights to remove content and limit accounts".
Cooking at your own judgement
Cooking involves heat, fire, hot oil, steam, knives, appliances and food that can make people ill if it is handled badly. You are responsible for how you cook and for what you and the people you cook for eat. Before you cook, check every ingredient and its label yourself, including for allergens, and check that a recipe suits everyone who will eat it. Use your own judgement, use a food thermometer, follow your appliance manuals and follow food-safety guidance such as FoodSafety.gov. Do not leave cooking unattended. If children are cooking, an adult must be close by.
Disclaimers
Each short note in the app has its full text here, with more detail. The short notes and these full texts are part of these terms.
Allergies
Allergy and ingredient information in Cookmee comes from our own ingredient data, the way we write recipes, and for community recipes, what the author declared. It is an aid, not a promise. We do not promise that any dish, ingredient, swap or shopping item is free of an allergen or suits your allergy, intolerance or diet. Ingredients, brands, recipes and factory processes change, and food can be mislabelled or touched by other foods. Words that we cannot match to our ingredient data are marked "Not checked".
Always read the full ingredient list and allergen statement on every product you buy or use, ask the maker when you are unsure, and talk to your doctor or allergist about your allergy. You are responsible for your own allergy decisions and for those of anyone you cook for. Do not rely on Cookmee where a reaction could be serious. If you or someone else has a reaction, use prescribed emergency medicine and call 911 or your local emergency number.
The allergy choices in the app cover the major US allergens and gluten. Other allergies and intolerances, for example to mustard, celery, spices or additives, are not covered, so the app cannot hide those. If you find a mistake, tell us through Feedback or Report.
Diet
Diet matching uses our ingredient data and, for community recipes, what the author declared. It is not a certification of any kind. Rules for halal, kosher, Jain, vegetarian, vegan and other diets differ between people and communities, and products and brands change. Buy certified products where it matters to you and check labels.
Data you send
- Esta imagen puede mostrar información personal. Quítala si tienes dudas.
Feedback you send is handled as the Privacy Policy describes. A screenshot can show personal information, so check it before you send it. Do not send other people's private information or health details.
Food safety
Food-safety notes in the app are general guidance based on public advice from agencies such as FoodSafety.gov, and are stricter than that advice in some places. They are not a promise about any particular food. Storage and keeping times are a guide: if in doubt, throw it out. Cook to the temperatures shown by a food thermometer, not by colour alone. People who are pregnant, very young, older or unwell are more at risk from food-borne illness and should ask their doctor about what they eat. Community recipes may not include our food-safety notes.
Cooking safety
Heat, hot oil, boiling liquid, steam, ovens, pressure cookers, sharp knives and other tools can cause burns, cuts, fires and other injuries. Follow the instructions of every appliance. Never leave hot oil or a hot pan unattended. If oil catches fire, turn off the heat and cover the pan with a lid; never use water. Keep children and pets away from heat and sharp tools. Notes in the app do not cover every risk in your kitchen.
Not medical or nutrition advice
Cookmee shares cooking ideas. It does not give medical, diet, allergy or nutrition advice, does not diagnose, treat or prevent any condition, and does not create a doctor-patient or dietitian-client relationship. It is not a substitute for professional advice. Talk to a doctor or dietitian before you change what you eat, especially if you are pregnant, have diabetes, kidney disease, an eating disorder or a food allergy, or take medicine. Never ignore or delay professional advice because of something in the app. Health claims made by community members are their own and are not checked by us. In an emergency, call 911 or your local emergency number. If numbers about food do not help you, you can switch off nutrition in settings.
Nutrition numbers
Nutrition numbers are estimates, worked out on your phone from ingredient data for one serving at the amounts shown. Brands, portions, cooking methods, swaps and the way you scale a recipe change the real values, and the numbers are not lab-tested or a food label. Do not use them to manage a medical condition or a prescribed diet.
Estimates
Cooking times, portions, costs, savings and keeping times are estimates. Your kitchen, equipment, ingredients, skill and appetite will give different results.
Points and badges
Points and badges are for fun and have no value. We may change, reset or remove them.
Links to other sites
Links lead to websites, videos, books and apps run by other people. We do not control them, we do not check them all the time, and we are not responsible for what they say, how they use your data or what happens when you use them. Their own terms and privacy policies apply. A link is not an endorsement.
Translations
Spanish and Hindi texts are translations and may differ slightly, and some legal documents are shown in English only. If there is a difference, the English text controls, as far as the law allows.
Food cultures
Food traditions differ between families, regions and communities. Our recipes, and those of community members, are one way to cook a dish, not the only one.
Trademarks
Names, logos and brands of others belong to their owners and are used only to name them. No one named here endorses Cookmee.
Recipes and accuracy
We work to keep our own recipes correct, but mistakes can happen, and results vary with equipment, ingredients, altitude and skill. Swaps, changes to servings and your own changes can change the taste, texture, safety and allergens of a dish, and you are responsible for them. We may change or remove recipes at any time.
Community recipes
Community recipes, profiles, notes and group posts are written by their authors, not by us. Their authors are responsible for them. We do not check every recipe, its steps, its allergens or its claims before others see it, even after a first-post check, and we do not adopt or endorse what an author says. Allergens on a community recipe are shown as the author described them. Treat every community recipe with extra care, and check every ingredient and label yourself.
Photos and share cards
Photos you take or add stay on your phone unless you share them. You are responsible for what you photograph and share, for having the right to share it, and for the permission of anyone shown. Share cards are posted by you through your phone's share sheet, and the apps you share to have their own rules. Do not share other people's private information.
Timers and notifications
Timers, alerts, reminders and Live Activities are conveniences. They can fail or arrive late, for example when your phone is silent, in battery saver or Do Not Disturb, when notifications are off, or when the system closes the app. Alerts in the bell can also be late or missing. Do not rely on them. Stay in the kitchen while you cook and keep your own watch on the food.
Points and badges
Points and badges are for fun. They have no cash value, cannot be sold or exchanged for anything, and are not property. We may change, reset or remove them, including when we close an account.
Your content
"Your content" is anything you share or send through the service: recipes, stories, steps, tips, credits, ingredient lines and allergen declarations, profile details, notes, group names, descriptions, rules and posts, reports and feedback.
You keep ownership of your content. To run, show, improve and promote the service, you give us a worldwide, non-exclusive, royalty-free, transferable licence, with the right to sublicense to our service providers and to other users as the service allows, to host, store, copy, show, perform, publish, distribute, translate, format, adapt (for example resize, scale servings, convert units or crop) and make derivative works of your content, in any media now known or later developed. This includes showing your content with your profile name in the app, on our website and in our own promotion of Cookmee, such as store listings and social media posts.
The licence lasts while your content is on the service. It ends when you or we delete the content, except: for copies other users already saved or were sent, for content in backups until they expire, for content we must keep by law or for a dispute, and for promotion material already published. Where the law allows, you waive, and agree not to assert, any moral rights or rights of attribution or integrity in your content against us or people we license.
When you share, you promise that:
- the content is your own words, or you have the right to share it, and you credited where a recipe comes from
- you listed the allergens as best you know, and you will fix them if you find a mistake
- it does not break the law, the Community rules or anyone's rights, including copyright, trademark, privacy and publicity rights
- anyone shown or named in it has agreed
You are responsible for your content and for what happens because you shared it. We are not responsible for content other users share. We do not pay for content, and sharing it does not make you our employee or partner.
Our rights to remove content and limit accounts
We may review, check before or after publishing, hide, limit who sees, refuse, edit for format, or remove any content, and we may warn, limit, suspend or close any account, at any time, if we think it breaks these terms or the Community rules, creates risk for anyone or for us, or if the law requires it. Where it is practical and does not put anyone at risk, we will tell you what we did and why, and you can ask us to look again as the Community rules explain. We do not have to monitor content, and we are not responsible for content we did not remove.
We apply daily limits on sharing and a check of an author's first recipes for Everyone. We may change these limits and checks at any time. We may report content and keep records when the law requires, for example apparent child sexual abuse material, which we report to the National Center for Missing and Exploited Children.
Groups
Groups are a place to show and share home cooking. They are not a marketplace. Do not use a group, a profile or a recipe to sell or offer food or anything else, to give prices, to arrange pickup, delivery or meetings, or to share addresses or locations. Group admins set rules for their group but cannot override these terms. Admins and members are responsible for what they post. We may remove a group or post, or change its admin, at any time.
Our content
The app, its design, code, recipes, photos and text are ours or used with permission, and are protected by copyright and other laws. Apart from the licence in "Using the app", we keep all rights. You may cook our recipes at home and share a recipe card or link with friends and family without charge. Inspiration links lead to other people's work, which stays theirs.
Links to other sites
Links to other sites, apps and services are there for your convenience. We do not control them and are not responsible for them. Using them is at your own risk and under their terms.
Feedback you send
When you send feedback, ideas or suggestions, you give us a perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose without paying or crediting you, and you confirm that you have the right to send them. We do not have to use them, keep them confidential or reply, and we may remove them. Do not include other people's private information, health details or anything unlawful. If you ask us to delete what you sent, we delete it as the Privacy Policy says, but we cannot undo changes already made to the app because of it.
Copyright and reports
We respect copyright and expect you to do the same. If you think content on the service copies your work, use Report in the app, or send a notice to our copyright agent: [copyright agent name, postal address and email: to be confirmed]. Your notice must include your signature (typed is fine), what the work is, where the content appears (for example the recipe or profile name, or the link), your contact details, a statement that you believe in good faith the use is not allowed by the owner, its agent or the law, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or may act for the owner.
We remove or disable content after a valid notice and tell the person who shared it. If you think we removed your content by mistake, you may send a counter-notice to the same agent with your signature, what was removed and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your name, address and phone number, and your agreement to the jurisdiction of the federal court for your area and to accept service from the person who sent the notice. We may restore the content 10 to 14 business days after a valid counter-notice unless the claimant tells us they have gone to court. False notices and counter-notices can make you liable for damages.
We close the accounts of people who infringe repeatedly. [Repeat-infringer threshold: to be confirmed.] We may also close an account after a single serious case. To ask us to remove an intimate image shared without consent, follow the steps on the "Remove an image" page in the app or on our website.
Updates and availability
The service is free and offered as available. Some features may be new, in testing or labelled beta, and may change or stop. We may change, pause, limit or end any part of the service, or the whole service, at any time, with or without notice, and we may update recipes and these terms. We do not promise support, updates, any level of service, or that the service or your content will always be available. Keep your own copy of anything that matters to you.
Apple and Google
These terms are between you and us only, not Apple or Google. We, not Apple or Google, are responsible for the app and its content. Your licence to use the app from the App Store is limited to Apple-branded products that you own or control, as the Usage Rules in Apple's Media Services Terms allow, and family members may use it through Family Sharing where it applies. Apple has no duty to provide maintenance or support for the app. If the app fails to meet a warranty that applies, you may tell Apple, and Apple will refund the price you paid for the app (if any). Apple has no other warranty duty, and any other claims, losses or costs from a failure to meet a warranty are ours to deal with, as far as these terms allow. We, not Apple, are responsible for handling any claims by you or anyone else about the app or your use of it, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. If anyone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim. You confirm that you are not in a country under a US embargo or named by the US government as a country that supports terrorism, and that you are not on any US list of prohibited or restricted parties. Follow any third-party terms that apply when you use the app, such as your phone plan. Questions, complaints and claims about the app go to us at the address in "Contact". Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you. Google's terms for Google Play also apply to downloads from Google Play, and Google is not a party to these terms.
No warranty
To the fullest extent the law allows, the service and all content in it, including community content, are provided "AS IS" and "AS AVAILABLE", with all faults and without any promise or warranty of any kind, express, implied or by law. This includes warranties of accuracy, completeness, quality, fitness for a particular purpose, merchantability, title and non-infringement, and any promise that the service will be uninterrupted, timely, secure or free of errors or harmful code, that allergen, diet, nutrition or food-safety information is right, or that any recipe will work or suit you. Nothing we or anyone else tells you creates a warranty. Some places do not allow some exclusions, so some of these may not apply to you.
Limits of our responsibility
To the fullest extent the law allows, we and our owners, officers, staff, contractors, suppliers and licensors (the "protected parties") are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or use, even if we were told they were possible.
To the fullest extent the law allows, the protected parties are not liable for any illness, allergic reaction, food-borne illness, burn, cut, fire, injury, property damage or other loss that results from cooking, eating, choosing ingredients, or relying on the service or any content in it, including community content, or from the conduct of other users, inside or outside the service.
For anything else, the protected parties' total liability for all claims about the service is limited to the greater of US$[liability cap: to be confirmed] or the amount you paid us in the 12 months before the claim. The service is free, and these limits are part of why we can offer it for free.
Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud, for gross negligence or wilful misconduct, or for death or personal injury caused by our negligence where the law forbids the limit. In those places, our liability is limited to the smallest amount the law allows.
Assumption of risk
Cooking and eating involve risks, including burns, cuts, fires, food-borne illness and allergic reactions, some of them serious. Community recipes are written by other people and may contain mistakes. You understand these risks and choose to cook, eat and rely on the service voluntarily. To the extent the law allows, you accept these risks yourself and release the protected parties from claims arising from them. If you live in California, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." [California release wording: to be confirmed.]
Your responsibility and indemnity
To the extent the law allows, you agree to defend, indemnify and hold harmless the protected parties against all claims, losses, damages, fines and costs (including reasonable lawyers' fees) that come from your content, your use or misuse of the service, your breach of these terms or the Community rules, your breach of anyone's rights or of the law, or claims by people you cook for that arise from your own decisions, such as about their allergies. We may take control of the defence of a claim at your cost, and you will cooperate with us. You may not settle a claim that affects us without our written consent. This does not apply to losses caused by our own fault where the law forbids it.
Settling disputes
[Lawyer choice: keep arbitration as written below (option A), or replace this section with courts only and a class-action waiver (option B). Arbitration should rely on the "Agree and continue" tap or the sign-in confirmation, not on use alone.]
Informal first step. Before you or we start any claim, the one starting it must send a written notice with their name, contact details, the account email if there is one, a description of the problem and what they want. Send yours to support@cookmee.com with the subject "Dispute". We will send ours to the email of your account or the email you wrote from. We both then try in good faith to settle it for 60 days. Time limits for the claim are paused during those 60 days.
Arbitration. If we cannot settle it, you and we agree that any dispute, claim or controversy about these terms, the service or your content, including whether this section applies or is valid, will be settled by binding arbitration on an individual basis, instead of in court before a judge or jury. The arbitration is run by [arbitration provider: to be confirmed] under its consumer rules, and the Federal Arbitration Act governs this section. The arbitrator may award the same individual relief a court could, but only to you or us and only as needed for the individual claim. You and we may still bring an individual claim in small-claims court, and either of us may go to court to stop misuse or infringement of intellectual property. [Fees, location and hearing format: to be confirmed.]
Class action waiver. You and we may bring claims only on our own behalf, and not as a plaintiff or member of any class, group, collective or representative action. The arbitrator may not combine claims of more than one person or preside over any class or representative proceeding. If a court decides that this waiver cannot be enforced for a claim, that claim goes to court, not arbitration, and stays paused until the individual arbitration is over.
Mass filings. If 25 or more similar claims are filed against us or by us by the same or coordinated lawyers or organisations, they are handled in batches, one batch at a time, with one arbitrator per batch, and time limits are paused while they wait. [Batch size and procedure: to be confirmed.]
Opt out. You may opt out of arbitration and the class waiver within 30 days of first accepting these terms, by emailing support@cookmee.com with the subject "Arbitration opt-out", your name, the email of your account if you have one, and a clear statement that you opt out of arbitration. If you opt out, disputes go to the courts named in "Governing law", and the other terms still apply. Opting out does not affect any earlier agreement you made with us to arbitrate.
Time limit. To the extent the law allows, any claim must be started within one year after it arose, or it is barred.
Changes to this section. If we change this section, we will tell you at least 30 days before. The change applies only to disputes that start after it takes effect. You may reject the change within those 30 days by emailing us, and then the earlier version keeps applying to you. This section survives if you stop using the service or delete your account.
Governing law
The Federal Arbitration Act, US federal law and the law of [governing state: to be confirmed] govern these terms, without regard to rules about conflicts of law. Subject to "Settling disputes", any dispute that goes to court will be heard only in the state or federal courts in [county and state: to be confirmed], and you and we agree to their jurisdiction. Consumer protection laws of the state where you live still apply where they cannot be waived.
Changes to these terms
We may change these terms and the Community rules at any time, for example when the service changes or the law does. The version number and date at the top show the latest version. If a change is material, we tell you before it takes effect, in the app (for example by asking you to agree again on the next start) or on our website. Other changes take effect when we publish them. If you keep using the service after a change takes effect, you accept the new version. If you do not agree, stop using the service, and you may delete your account. Changes to "Settling disputes" follow the rule in that section.
Ending
You may stop using the service at any time by deleting the app, and you may delete your account in the app. We may suspend or end your access, or close your account, at any time if you break these terms or the Community rules, if the law requires it, if your use creates risk or harm, or if we stop offering the service. If we close your account for a breach, do not make a new one. Sections that by their nature should continue after the end continue, including your content licence for content already shared, the disclaimers, assumption of risk, limits of our responsibility, indemnity, settling disputes, governing law and General.
Accessibility
We aim to make the app usable by everyone, and design for screen readers, large text and good contrast. We cannot promise it is perfect. If you have trouble, tell us at support@cookmee.com and we will try to help.
General
- Entire agreement: these terms, the Community rules, any rules shown in the app for a feature, and the Privacy Policy are the whole agreement between you and us about the service, and they replace any earlier agreement about it. If they conflict, these terms control.
- Severability: if a part is found unenforceable, it is changed to the smallest extent needed to make it enforceable, and the rest stays in force. Under "Settling disputes", the class-waiver rule in that section applies instead.
- No waiver: if we do not use or enforce a right, we have not given it up.
- Transfer: you may not transfer these terms or your rights under them. We may transfer ours, for example in a merger or sale of the company.
- Events outside our control: we are not responsible for delays or failures caused by events outside our reasonable control, such as outages of the internet, of providers or of power, natural events, war, strikes or acts of government.
- Export: you agree to follow US export and sanctions laws when you use the service.
- Notices: we may send you notices in the app, by email to your account email, or on our website. You send notices to us at the address in "Contact".
- No third-party rights: apart from Apple and its subsidiaries, as set out above, no one else has rights under these terms.
- Headings and examples are for convenience. "Including" means including without limit.
- Relationship: nothing in these terms makes you and us partners, employees or agents of each other.
